Personal Injury Cap
In 2009, the Alberta Court of Appeal upheld the 2004 Minor Injury Regulation. This means that your injury compensation can be limited or capped in certain instances. The cap only applies to automobile accident claims, and only caps or limits certain injuries that are considered "minor" as defined in the regulations. Injury claims for non-minor injuries are not affected by the Regulation. The cap is adjusted for inflation every year. For accidents that occurred in 2022, the cap is $5,488.00. For accidents that occur in 2023, the cap is $5,817.00 In attempting to resolve your injury claim, insurers tend to offer to resolve your injury claim for less than the capped amount, or they neglect to inform you that there might be additional compensation that you are entitled to. If you try to resolve your claim on your own, remember that an insurer cannot give you legal advice, and that it is in their interests to pay out as little as possible to resolve your claim.
